Privacy Policy
This privacy policy explains the nature, scope and purpose of our processing of personal data (also referred to below as “data”). Personal data is any information relating to you personally, such as your name, address, email address or user behaviour. This policy applies to all data processing we carry out, both as part of our core activities and through the online media we provide.
Who is responsible for processing your data
The controller responsible for data processing is:
David Hillmer
Friedrich-Ebert-Straße 23
65239 Germany
contact@davidhillmer.com
Processing your data as part of our agency services
We provide agency services. If you are our customer or business partner, or are interested in our services, the nature, scope and purpose of processing your data depend on the contractual or pre-contractual services between us. These include conceptual and strategic consulting, software and design development, consulting and maintenance in these areas, planning and implementing campaigns, IT and server administration, and other consulting and training services. The data we process therefore includes all information you provide or have provided to use contractual or pre-contractual services and that is needed to handle your enquiry or fulfil our contract. Unless otherwise stated in this policy, processing and disclosure to third parties are limited to the data necessary and appropriate to answer your enquiries, fulfil the contract between us, protect our rights and comply with legal obligations. We tell you which data is required before or when we collect it. Where we use third-party providers to deliver our services, their respective privacy policies apply.
Data concerned:
- Basic personal data (e.g. names, addresses)
- Payment data (e.g. bank details, invoices)
- Contact data (e.g. email address, telephone number, postal address)
- Contract data (e.g. subject matter and duration of the contract)
Data subjects: Customers, prospective customers, business partners and contractual partners
Purpose of processing: Delivery of contractual services, communication and responding to contact enquiries, office and organisational procedures
Legal basis: Performance of a contract and pre-contractual enquiries, Article 6(1)(b) GDPR; legal obligation, Article 6(1)(c) GDPR; legitimate interest, Article 6(1)(f) GDPR
Your rights under the GDPR
Under the GDPR, you have the following rights, which you may exercise at any time with the controller named in section 1 of this privacy policy:
- Right of access: You have the right to ask us whether we process data about you and, if so, which data.
- Right to rectification: You have the right to request the correction of inaccurate data or the completion of incomplete data.
- Right to erasure: You have the right to request the deletion of your data.
- Right to restriction: In certain circumstances, you have the right to request that we restrict the processing of your data.
- Right to data portability: You have the right to request that we transfer your data to you or another controller in a structured, commonly used and machine-readable format.
- Right to lodge a complaint: You have the right to complain to a supervisory authority. The competent authority is that of your habitual residence, your workplace or our registered office.
Right to withdraw consent
You have the right to withdraw your consent to data processing at any time.
Right to object
You have the right to object at any time to processing of your data based on our legitimate interest under Article 6(1)(f) GDPR. If you exercise this right, please explain your reasons. We will then stop processing your personal data unless we can demonstrate compelling legitimate grounds that outweigh your interests and rights.
Regardless of the above, you have the right to object at any time to the processing of your personal data for advertising and data analysis purposes.
Please send your objection to the controller’s contact address given above.
When do we delete your data?
We delete your data when we no longer need it or when you instruct us to do so. Unless otherwise stated in the individual notices in this privacy policy, this means we delete your data:
- when the purpose of processing no longer applies and the legal basis stated in the relevant privacy notice therefore ceases to apply, for example:
- after the contractual or membership relationship between us ends (Article 6(1)(a) GDPR), or
- when our legitimate interest in continuing to process or store your data no longer applies (Article 6(1)(f) GDPR);
- when you withdraw your consent and there is no other legal basis for processing under Article 6(1)(b)–(f) GDPR;
- when you exercise your right to object and there are no compelling legitimate grounds preventing deletion.
If we still need to retain some or all of your data for other purposes, for example because of tax retention periods (generally six years for business correspondence and ten years for accounting records), the establishment, exercise or defence of legal claims arising from contractual relationships (up to four years), or to protect another natural or legal person’s rights, we delete that data only after these periods have expired. Until then, we restrict processing to these purposes, including compliance with retention obligations.
Cloud services
We use cloud services in particular:
- to store and edit documents;
- to send documents by email and exchange files of all kinds;
- to manage our calendar and appointments;
- to prepare and deliver presentations and spreadsheets;

The providers listed below make the software applications we use for these purposes available on their servers, which we access over the internet. If you send us data when communicating with us or through other processes described in this policy, we process it in the cloud service we use. This means your data is stored on the third-party cloud provider’s servers. Third-party providers process usage data and metadata to secure their servers and optimise their services. In particular, we process and store your contact, customer and contract data.
If we make files of any kind publicly available on our website through the cloud service we use, the respective third-party cloud provider may store cookies on your computer when you access these files. The provider may process the data collected in this way to analyse your usage behaviour or browser settings.
Depending on the country in which the provider named below is based, the data described below may be transferred to and processed on servers outside the European Union. In this case, there is a risk that the level of data protection required by the GDPR may not be met and that you may be unable to enforce your rights, or may find it more difficult to do so. Where the provider offers processing exclusively within the EU, we intend to process your data only there, unless we already do so.

Cookies
Our website uses cookies. Cookies are small text files consisting of a sequence of numbers and letters that are placed and stored on your device. Their main purpose is to exchange information between your device and our website. This includes language settings, login status or the point you have reached in a video.
Two types of cookies are used when you visit our website:
- Temporary cookies (session cookies): These store a session ID that allows different requests from your browser to be assigned to the same session. Session cookies are deleted when you log out or close your browser.
- Persistent cookies: Persistent cookies remain stored after you close your browser. They allow our website to recognise your computer when you return. These cookies may store information such as language settings or login details. They can also record and store your browsing behaviour. This data may be used for statistical, marketing and personalisation purposes.
In addition to the categories above, cookies can be distinguished by their purpose:
- Necessary cookies: These cookies are essential to operate our website, for example to store login or shopping basket information for the duration of your session, or are set for security reasons.
- Statistical, marketing and personalisation cookies: These cookies are used for analysis or audience measurement. Tracking cookies may store information about search terms entered or how often pages are viewed. An individual user’s browsing behaviour, such as viewing particular content or using particular functions, may also be stored in a user profile. These profiles are used to show users content matching their potential interests. Where we use services that store statistical, marketing or personalisation cookies on your device, we explain this separately in the following sections of this policy or when seeking your consent.
Data concerned:
- Usage data (e.g. access times, websites clicked)
- Communication data (e.g. information about the device used, IP address).
Data subjects: Users of our online services
Purpose of processing: Displaying our website, ensuring its operation, improving our online services, communication and marketing
Legal basis: Legitimate interest, Article 6(1)(f) GDPR. Where we do not ask for your consent to set cookies, we base processing on our legitimate interest in improving the quality and usability of our website, particularly its content and functions. You can object to cookies set on the basis of our legitimate interest through your browser’s security settings. There you can choose to reject all cookies, accept them only when prompted, or delete cookies whenever you close your browser. If you disable cookies for our website, some functions may no longer be fully available.
Consent, Article 6(1)(a) GDPR. If we ask you before your visit for permission to place certain cookies on your device and you agree, your consent is the legal basis. When seeking consent, we tell you which cookies we set. If you do not consent, only technically necessary cookies required for the proper operation and display of our website in your browser are set. You may withdraw your consent to cookies at any time.
Web hosting
We use a hosting provider whose servers store our website and make it available on the internet. The provider may process any data transmitted through your browser when you use our website. This includes your IP address, which the provider needs to deliver our online services to your browser, and any information you enter on our website. The provider may also collect:

Content delivery network
We use a content delivery network (CDN) to deliver our website. A CDN is a network of geographically distributed servers connected through the internet. It provides scalable storage and delivery capacity, optimising website loading times and ensuring efficient data transfer even during large traffic spikes. Requests to our website are routed through CDN servers. Statistics are generated from these data flows to help identify potential malware threats at an early stage and continuously improve our services and the usability of our website.
Depending on the country in which the provider named below is based, data collected through the service may be transferred to and processed outside the European Union. In this case, there is a risk that the level of data protection required by the GDPR may not be met and that you may be unable to enforce your rights, or may find it more difficult to do so.
Data concerned:
- Content data (e.g. posts, photos, videos)
- Usage data (e.g. access times, websites clicked)
- Communication data (e.g. information about the device used, IP address)
Purpose of processing: Technical optimisation of our website, analysis of errors and user behaviour

Handling your data during the application process
If you apply for a position with us, we process the personal data you provide during the application process, such as your name, address, place of residence, age, application photo, email address, telephone number and professional history, including school, vocational training and higher education. If you send this data by email or through a contact form on our website, it is processed electronically. Applications submitted through our contact form are transmitted using current encryption technology. If you send your data by email, please note that transmission is generally unencrypted. If the application process leads to an employment contract, we store your data to administer the employment relationship in accordance with legal requirements.
Data concerned:
- Basic personal data (e.g. names, addresses)
- Payment data (e.g. bank details, invoices)
- Contact data (e.g. email address, telephone number, postal address)

This does not apply where legal provisions prevent deletion or continued storage is necessary for evidence, for example in proceedings under the German General Act on Equal Treatment (AGG). The application process is considered complete when the rejection is sent to you.
Online advertising
We use services to display online advertising. These services collect certain user data through a cookie or pixel. This includes the website from which you reached our website (the referrer), the pages you accessed, how long you visited them and the interactions you made. Data about your browser, computer system and device type is also collected. Demographic information, such as age or gender, may be recorded as pseudonymous values. If you have consented to location data collection, this may also be processed, depending on the provider. To collect and store this data, the service places a cookie or tracking pixel on your device, which also collects your IP address. However, the address is shortened through IP masking so that it can no longer be associated with your visit to our website. Generally, directly identifying data such as names or email addresses is not stored when using these services. An exception is where you are a member of a social network offering one of the services listed below and it combines your profile with this data.
The service we use analyses the data to produce a statistical report on the number of visitors generated by advertising and the success of the campaign. Reports include the total number of users directed to our website through our advertisements, information about their devices and browsers, their locations and when advertisements were clicked. They do not contain information that could personally identify you as a user of our website.
Depending on where the provider is based, data collected through the service may be transferred to and processed outside the European Union. In this case, there is a risk that the level of data protection required by the GDPR may not be met and that you may be unable to enforce your rights, or may find it more difficult to do so.
Data concerned:
- Usage data (e.g. access times, websites clicked)
- Communication data (e.g. information about the device used, IP address)
Data subjects: Users of our online services
Purpose of processing: Audience measurement, campaign performance monitoring, remarketing, and interest-based and behavioural marketing
Legal basis: If we ask for your consent before using a service, that consent forms the legal basis under Article 6(1)(a) GDPR. Otherwise, we use the service on the basis of our legitimate interest in directing visitors to our website and analysing visitor traffic to continuously improve its functions, services and user experience, under Article 6(1)(f) GDPR.
We use the following providers for online advertising:

Web analytics and statistics
We use web analytics services to record and statistically evaluate visitor traffic on our website. These services collect information such as the website from which you reached ours (the referrer), the pages you accessed, how long you visited them and the interactions you made. Data about your browser, computer system and device type is also collected. Demographic information, such as age or gender, may be recorded as pseudonymous values. If you have consented to location data collection, this may also be processed, depending on the provider.
To collect and store this data, the web analytics service we use places a cookie on your device, which also collects your IP address. However, the address is shortened through IP masking so that it can no longer be associated with your visit to our website. Other directly identifying data, such as names or email addresses, is not stored either. Neither we nor the service we use knows the identity of visitors to our website.
Depending on the country in which the provider named below is based, data collected through the service may be transferred to and processed outside the European Union. In this case, there is a risk that the level of data protection required by the GDPR may not be met and that you may be unable to enforce your rights, or may find it more difficult to do so.
